Mitch Portnoi Obtains $750,000 Settlement on Malpractice Claim

Mitch Portnoi has resolved a legal malpractice claim for $750,000 for a client whose prior attorney failed to properly handle a worker’s compensation matter and failed to file a complaint in a related case against a third party. Our client suffered a workplace fall, resulting in a serious neck injury. It was alleged that the fall occurred due to the negligence of a third party. Mitch successfully resolved the worker’s compensation matter and proceeded to litigate against the former attorney who had failed to act on the third party claim. Notwithstanding issues raised by the defendant attorney regarding liability of the third party (who could no longer be pursued due to the attorney’s alleged negligence but whose liability would still have to be established in order to recover against the attorney) Mitch was able to establish sufficient proof of underlying liability and damages that the carrier agreed to resolve the matter for the substantial sum stated above.
